Anyone know how it works?

I've made 3 milestone payments, got one payment still in escrow, plus two more payments I haven't paid yet. At this point the developer is 2 months over when he said he could deliver it (1 month) and still its not working properly. Also I gave him a lot of the base code but for this part of the project (android) I didn't.

After beginning this project I realised I overpaid because he originally bidded on this job for the first project and that included all aspects from scratch. This one I was giving him all the backend and the website which didn't need any changing. And only the base code for iOS and database sql needed fixing. Since I already agreed to start the project I was happy with this as long as he could deliver what I wanted.

Maybe I am too much of a pushover because he has the details to all my accounts and I have always given him leeway to fix problems even though the most basic shit is foreign to them.

I now get the feeling he is constantly trying to push me into believing the app is working fine just so he can complete the project. I got the feeling that he was working on other projects at the same time as well because for 3 weeks there was no process.

It really fucks me off how useless these indian app developers are and I can't help but think they are all like this. I want to know, am I able to get a refund for the whole job or is that impossible?
He did deliver for the first part of the project but at this point I am giving up.. this is the second developer I hired for this project with the first being even worse.

I'm ok with cutting my losses and just getting the refund for my escrow amount. Right now I just want to destroy their rating on elance so no one hires these guys again.

I have now had two really bad experiences hiring indians as app developers and getting ready to cancel this project if he can't fix the problems in the next few days..

Advice?
