You’re an American citizen, returning from a trip abroad. As you pass through customs, what can customs agents do with your phone, laptop, tablet, or any other digital device you may be carrying? As U.S.-born NASA scientist Sidd Bikkannavar found out when returning from Chile in early February, they can aggressively press you to give up your phone’s PIN, copy everything on your phone, and then send you on your way.

While the U.S. Customs and Border Protection (CBP) is the nation’s largest law-enforcement agency, it operates under a significantly different set of regulations than your local police department. And that means it can search the phone of anyone — whether you’re a U.S. citizen or foreign national — who crosses the U.S. border, even without the suspicion that someone is committing a crime.

Why? It all comes down to something called the “border search exception.”

This border search exception, I presume, means that they do not need a warrant to search your phone?

And this also applies to tablets and laptops, etc?

Answer to your first question: Yes. They do not need a warrant.

Second question: It applies to everything. CBP guys are major dicks and will seize your equipment if you don't cooperate.

Might just leave my laptop overseas and get a burner phone when visiting the U.S. Most of my data is in the cloud anyway, so I can access it from another computer there.

Trusting your data to 'the cloud' is just as bad as entrusting it to the border patrol goons. All 'the cloud' is, is someone else's drive! If you do not have absolute control over it, then you have zero control over it. Avoid Google, Amazon, Facebook and the like if you value privacy.

As far as data goes, if I need to transfer something internationally, I do so via encryption. Upload it to my server while in say Peru and then retrieve it stateside.

Also agree that Border Officers are complete dicks. I cross the Rainbow Bridge at Niagara Falls quite regularly and it never seems to matter which passport I give them. I always end up with a guy who thinks he's Charles Bronson.

In regard to U.S. citizens, most of the U.S. federal circuit courts have held that border agents must have a reasonable suspicion to conduct a search of electronics. But it is an unsettled question that will eventually reach the U.S. Supreme Court.

The really bad actor right now is the U.K., where a statute unambiguously allows border agents to force you to give up your passwords. It is fairly rare for that to happen in the U.S.

If you put it encrypted in the cloud you are relatively safe. Until they crack the "uncrackable" encryption, that is.

But you should not trust any sensitive data on technology, if you ask me. Won't bel long before it's possible to sniff all data in close proximity. There is no such thing as digital security.

It's not that bad yet... Except in movies. Smile If your data is properly encrypted in a hard drive, it's not easy or even possible for them to retrieve it, directly and definitely not from a distance (offline), now or anytime soon!

The problem in encryption is that they may or may not have a backdoor (or "master key") to that particular encryption software... It's best to use open source software in my opinion, for example Truecrypt which was discontinued a long time ago. It doesn't get any updates but seems to work just fine.

Canada is really bad for this, I had a little "incident" last year that involved me getting arrested, detained and strip searched by the CBSA. They made me get naked and lift up my ball sack, shake my weiner then bend over and cough to see if anything came out of my butt hole. Then they searched everything, made me give them my laptop and phone along with passwords due to the fact that I was coming from a country that is known for child sex tourism, I told them they may see some cock pics but all titty and beaver pics were girls over 18. They looked at my phone pics and decided it was ok and didn't bother searching my laptop, then they took my toothbrush and razor and put them into a machine to test it for cocaine. I just complied with everything because I wanted to get out of there but the whole thing ended up taking three hours, thankfully the Mounties decided not to charge me for the half gram of ganja they found in my coat pocket, fucking dumb stoner move that was!

God damned them all, I was told we'd cruise the seas for American gold, we'd fire no guns-shed no tears, now I'm a broken man on a Halifax pier, the last of Barrett's privateers!

Don't get me wrong. The solution is not to throw a fit at a border station and get arrested. The solution is to keep your head down and evade the blue pill stupidity by doing what other members have already suggested (use encrypted data, cloud storage systems, hidden hard drive partitions, etc.).
