What do you guys think, I dont know how you could mistake a 12 year old for a 16 year old but Im sure there are exceptions out there. Overall I give him the benefit of the doubt and happy for him to not have his life ruined.

A man who raped a 12-year-old girl has walked free from court with no punishment.
Daniel Cieslak (21) of Leith in Edinburgh, was granted an absolute discharge by a judge in the High Court in Glasgow.
The court heard the student had sex with the girl in July 2015 after meeting her at a taxi rank in Edinburgh city centre, Scottish regional news service STV News reports.

Cieslak admitted he had sex with the girl but denied it was rape. He said he genuinely believed she was 16 and reportedly burst into tears when police revealed her true age.
Judge Lady Scott said she had decided “justice is best served” by taking the “wholly exceptional decision” to give Cieslak an absolute discharge.

She said the purpose of the law was to “protect young girls” but that there were “exceptional circumstances” and no public interest in a punishment in this case.
There was no suggestion of grooming and the 12-year-old girl was sexually active, the judge told the court.

Cieslak will not be put on the sex offenders list.
The court heard the girl was in a taxi queue with her friend when they started to talk to Cieslak and his friend. They all got in a taxi together and went to a flat in Gorgie, where they had sex, the court heard.

Days later, the girl told her sister she was worried she could be pregnant. Her GP encouraged her to go to the police and and the girl’s sister reported the incident.

I wish the article gave more details about the law and the case. They don't tell us what the judge was basing her ruling on.

According to Wikipedia (for what that's worth), this is Scotland's statutory rape law:

In Scotland, the Sexual Offences (Scotland) Act 2009 also fixes an age of consent of 16, and is also two tiered, treating children under 13 differently than children 13–16. Section 18, Rape of a young child, applies to children under 13. Before the enactment of this Act, Scotland had very few statutory sexual offences, with most of its sexual legislation being defined at common law, which was increasingly seen as a problem in particular for the issue of consent.[36] The creation of a two tier age limit was deemed very important during the drafting of the Act.

Hey,

This guy was a student of where I work and it actually has cost him his degree, so the effects of this was quite traumatic for him.

Daniel never denied he had sex with her, and the the girl even admitted that she lied about her age..She owned up to this, and this is what made it consensual in the judges eyes. This admittance saved him.

Think of the repercussions for the dude. A lifetime of not being able to rent an apartment or get a job. Fuck that. It's oppressive. A man in the States can beat the hell out of a 15 year old girl and not get the same jail time and lifetime sex registry punishment as a guy that has consensual sex with a girl that lied about her age.

He is lucky she owned up, many dont and the ones who do wait years in some cases. This is why the law needs to be fixed, it should not be that a womans word is worth more than a mans. Also he should not be publicly branded a rapist which stigmatises him for the rest of his life, his privacy should be protected unless convicted, even then I dont agree with publishing it. Not going to jail and not having a record at least affords him the chance to move away and start fresh so good luck to him.

I honestly did not know about this girl until just now but she is a perfect example of why Statutory Rape Laws do not need to be strict liability. She is exactly the fatherless, poorly supervised, manipulative girl who could easily fuck up a man's life. This cases and the one Atlanta Man brought up are hard to discern without having the court transcript or following case very closely. It does sound like justice was done in the OP article.

I'm fine with strict liability in these cases because the burden of prosecution is kept reasonable.

What dumbfounds me is when a 16 year old guy sleeps with a 16 year old girl and they charge HIM with statutory rape. That happens EVERY day of the year.

The court was right for not punishing him, if she actually looked mature enough.

At some point there will need to be strict punishments for when these underage girls lie about being older.

How is this any different if you sneak into a night club at 16?
If the cops catch you drinking underage you are unbelievably fucked. This is because you went out of your way to do something that is illegal.
Yet we can have some underage tart lying about her age and to guys and just getting them thrown in jail left and right.
Not that I condone it, but I wouldn't be surprised at some point in the future some poor guy that's been fucked over by some lying bitch ends up murdering her.
