Toward the end of the article it says the wife had already moved out of their shared home into an apartment after apparently separating.

If that's the case and they were separated, he shouldn't be entitled to diddly and the onus should have fallen on him to be macking it up around town rather than some jilted de facto ex-husband. He runs a BMX show, plenty of his associates would know many good looking girls.

"Alienation of Affection" man what the fuck is that about. I can't support putting any legal or even moral liability on the outsider. The problems with those two's marriage is their problem not his, just because the dude's wife is a cheating hoe doesn't mean the dude just getting his dick wet should be getting the shaft. If anything sue the wife for breach of marriage contact - that makes the most sense to me.

Those used to be "breach of promise to marry" laws, which punished men for having sex with women and then leaving instead of marrying. A big part of why those laws went the way of the Dodo was the introduction of the engagement ring, in theory worth three months wages as a sort of reverse dowry for marriage.
