I was renting an apartment from August to July of this year, but I ended up getting someone else to move in after four months. Basically, we didn't sublet it. I signed that my contract was terminated, and the other guy signed a new one. Now, in order to do this, I paid the other guy 600 bucks, since it was halfway through our school semester and I wasn't confident that I could find someone else for it. I was going to give it to the new renter in cash, but my landlord ended up just making the new guy's rent cheaper, and he said he would take it out of my security deposit. OK, that's fine, so I should be getting back $1000 total instead of $1600.

Landlord sent me an email today saying he had sent me a check for $1600, which I was happy about, if a little confused. About an hour later, he sends another stating that it should have been 300 less, and asked if he should put a stop payment on it. I have texts from the new guy where it seems like I am giving him cash for the room. The landlord doesn't have anything saying how much I owe, since he can't remember. The only documentation that exists is the new lease for a lower dollar amount that the new tenant signed, and the document stating my lease was over. Can I legally get away with depositing this check? I'm leaving the country in a month and I'd like the extra money. Thoughts?

I could get away with robbing the store my friend works at. Doesn't mean it'd be moral for me to do so.

Just be honest about it. I guarantee it will come back to you in good ways.

I'm going to agree with him that it was 1300. He should have kept documentation, he is a real estate agent.

Whatever you do, don't pay the landlord any cash until the check clears if you do deposit it.

Don't be a dick. Give him the money he is deserved. Be grateful he decided on 300 instead of the full 600.
